Terms of Service

1. Agreement

These terms govern your use of SigForms (the "Service"). By creating an account or signing a document through the Service, you agree to them. If you are agreeing on behalf of an organisation, you confirm you have authority to bind that organisation.

2. Accounts

You are responsible for the accuracy of your account information, for keeping your password confidential, and for all activity under your account. Tell us promptly if you believe your account has been accessed without your permission.

3. Your content

You keep all rights to the documents you upload and the data collected through them ("Your Content"). You grant us only the licence needed to host, process and deliver Your Content in order to run the Service for you. You are responsible for having the right to upload Your Content and to collect the information your forms request.

4. Electronic signatures

The Service creates electronic signatures and records intended to be valid under the U.S. ESIGN Act and UETA. Before signing, each signer is asked to consent to signing electronically. Signers may withdraw that consent by declining to sign and contacting the party that sent the document. Each completed document is accompanied by a signature certificate recording the signer's name, timestamps, IP address and browser, and completed documents can be downloaded and retained.

We do not verify the identity of signers beyond the information they provide. If your use requires stronger identity assurance, you are responsible for arranging it.

5. Acceptable use

Do not use the Service unlawfully or to infringe anyone's rights.
Do not upload malware or attempt to break, probe or overload the Service.
Do not send documents to people who have not agreed to hear from you.
Do not misrepresent who is sending a document or forge another person's signature.

6. Health information

The Service can be used to collect health information. If you are a HIPAA covered entity or business associate, you may only use the Service for protected health information if we have signed a Business Associate Agreement with you. Ask us before uploading such documents.

7. Availability and changes

We aim to keep the Service available but do not guarantee uninterrupted access. We may change or discontinue features, and will give reasonable notice of material changes that affect you.

8. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate accounts that breach these terms. On termination you may export Your Content for a reasonable period, after which it may be deleted.

9. Disclaimers and liability

The Service is provided "as is" without warranties of any kind, to the extent the law allows. We are not liable for indirect or consequential losses, and our total liability is limited to the amount you paid for the Service in the twelve months before the claim.
